The Decision of the Standing Committee of the
National People's Congress on Amending the Banking Supervision Law of the
People's Republic of China has been adopted by the 10th Session Standing
Committee of the National People's Congress of the People's Republic of China in
its 24th meeting on Oct. 31, 2006. It is now promulgated and shall come into
effect from Jul. 1, 2007.

Decision of the Standing Committee of the National
People's Congress on Amending the Banking Supervision Law of the People's
Republic of China
(Adopted by the 10th Session Standing Committee of
the National People's Congress of the People's Republic of China in its 24th
meeting on Oct. 31, 2006)
According to the Decision of the Standing Committee
of the National People's Congress, the Banking Supervision Law of the People's
Republic of China is amended as following:
I. One article is added as Article 42: "The banking
supervision authority, during the examination on banking financial organization,
may take following measures for the suspected units and individuals involvement
in illegal affairs with the approval of chief of banking supervision authority
at municipal level or above:"
(I) Inquiring the relevant unit or individual about
making explanation for the condition concerned;
(II) Referring and copying the relevant financial
& accounting documents, and registration documents of property right or
like;
(III) Registering and keeping the documents or
materials that are possible to be transferred, hidden, damaged or
counterfeited; |
