The Employment Promotion Law of the People's
Republic of China has been approved in the 29th meeting of Standing Committee of
the 10th National People's Congress on Aug. 30, 2007. It is now promulgated and
shall come into force from the Jan. 1, 2008.

Chapter I General Provisions
Article 1 This Law is enacted for promoting the
employment,furthering the coordination between economic development and
employment expansion, and strengthening the social harmony and stability.
Article 2 The State has laid importance on the
employment expansion for the economic and social development by means of
implementing encouraging employment policy, insisting independent employment of
labor, employment by market regulation and by governmental encouragement to
broaden the channels of employment.
Article 3 The labors have equal rights of employment
and independent employment according to the law.
The labors shall not be discriminated against the
race, ethnics, sex and religious belief or like for employment.
Article 4 The People's Government at or above the
county level shall take the employment expansion as an important aim for the
economic & social development by incorporating it into the national economy
and social development planning, while preparing the mid. and long term planning
and annual work plan for the promotion of employment.
Article 5 The People's Government at or above the
county level shall create employment conditions and expand employment through
developing economy, regulating industrial structure, standardizing human
resource market, improving employment service and strengthening vocational
education and training, and providing employment aid or like.
Article 6 The State Council will establish the
national employment promotion coordination mechanism to study the important
issues in employment, and help drive forward the employment promotion
nationwide. The labor administrative department under the State Council is
responsible for the national employment promotion work.
The People's Government at the level of province,
autonomous region and municipal directly under the central government shall,
upon the need of employment promotion, set up the employment coordination
mechanism to help solve important issues occurred in the employment within its
administrative area.
The relevant departments of the People's Government
at or above the county level shall have cooperation in the employment promotion
on the basis of their different work responsibilities.
Article 7 The State advocates that the labor shall
have proper employment concept, improve the capability of employment and
venturing; and encourages the venturing and independent employment of labors.
The People's Government and relevant departments at
all levels shall simplify the procedures and improve work efficiency to
facilitate the venturing and independent employment of labors.
Article 8 The employer has the independent right of
employing labors according to the law.
The employer shall safeguard the legitimate
interests and rights of labors according this law and other applicable laws and
regulations.
Article 9 The Labor Union, Communist Youth League,
Women Association, Disabled Person’s Federation and other social organizations
shall assist the people’s government in developing and promoting the employment,
and safeguard the working right of labors according to the law.
Article 10 The People's Government and relevant
departments at all levels shall commend and award the institution and individual
having outstanding achievements in employment
promotion. |
